KARACHI (HRNW) – The Additional Sessions Judge Court No. 2 (South) Karachi has granted bail to Mir Muhammad Magsi, who was accused of possessing and circulating counterfeit currency. The court approved the bail application against a surety bond of Rs 100,000, effectively disposing of the petition.
Defense Arguments and Legal Discrepancies
During the proceedings, defense counsel presented several arguments challenging the prosecution’s case, maintaining that his client is innocent and falsely implicated. The key points raised by the defense included:

Lack of Material Evidence: The serial numbers of the allegedly recovered fake notes were not mentioned in the FIR. Furthermore, the names and statements of the individuals to whom the counterfeit currency was supposedly given were not recorded.

Allegations of Police Misconduct: The counsel alleged that the police stopped the suspect under the pretext of a search and demanded his CNIC. When he could not provide it, the police allegedly demanded a bribe; upon refusal, he was framed in a case involving Rs 89,000 in fake currency.

Absence of Private Witnesses: No private citizens were made witnesses during the recovery process. The defense argued that the reliance solely on police witnesses creates significant doubt regarding the prosecution’s narrative.
Violation of Judicial Directives
Advocate Liaquat Ali Khan Gabol informed the court that the accused had been in jail for a year without a trial. He highlighted that the Sindh High Court had previously ordered the conclusion of the case within three months. Despite this directive, the prosecution failed to produce witnesses against the accused. Additionally, the court was informed that the suspect has no prior criminal record.
Case Background
The case against Mir Muhammad Magsi was registered at the Tipu Sultan Police Station under FIR No. 127/2025. The charges were filed under sections 489-B (Using as genuine, forged or counterfeit currency-notes or bank-notes) and 489-C (Possession of forged or counterfeit currency-notes or bank-notes) of the Pakistan Penal Code. After reviewing the arguments, the court ordered the suspect’s release on bail.
