Peshawar (HRNW)- The Peshawar High Court has dismissed an appeal filed by former Khyber Pakhtunkhwa provincial minister Shaukat Yousafzai against a damages award, citing failure by the petitioner and his counsel to pursue the case.
The court noted in its written ruling that the matter was called repeatedly, but neither Shaukat Yousafzai nor his lawyer appeared before the bench.
The court observed that, in the absence of the petitioner and his counsel, it had no option but to dismiss the appeal for lack of prosecution. It further remarked that the petitioner appeared to have lost interest in pursuing the matter.
The damages case had been filed by Asfandyar Wali Khan, former central president of the Awami National Party, against Shaukat Yousafzai. The District Court had previously ruled against the former provincial minister and ordered him to pay damages.
Yousafzai subsequently challenged the District Court’s decision and the damages award before the Peshawar High Court.
The High Court has now dismissed the appeal because the petitioner and his counsel failed to appear and pursue the proceedings, leaving the earlier District Court ruling in place.
