Supreme Court Grants Bail in Rape Case, Emphasizes Need for Serious Investigations Regardless of Severity of Allegation

Islamabad (HRNW)- The Supreme Court approved the bail application of a suspect involved in a rape case, noting that the gravity of an allegation must be matched by equally serious investigations.

During the hearing, the defense counsel argued that the accused completely denies the charges. Justice Mandokhail remarked that not every reported case is confirmed as rape, and many incidents go unreported; the punishment should correspond to the proven crime.

Justice Malik Shahzad Ahmed Khan emphasized that it is the responsibility of the complainant to prove the allegation, not the accused, and that a conviction cannot be based solely on the victim’s testimony.

Justice Musrat Hilali questioned, “If the woman herself admits the rape, what other evidence is required? Who would falsely accuse their own daughter and make a spectacle?”
