Supreme Court Rules Government Employees’ Salaries Cannot Be Withheld or Reduced as Punishment

Islamabad (HRNW): In a significant ruling concerning the rights of public servants, the Supreme Court of Pakistan has held that the salary of a government employee cannot be withheld or reduced as a form of punishment.

The Court clarified that neither the government nor any public department has the authority to stop or deduct an employee’s salary as a disciplinary measure unless such action is expressly authorized by law. It emphasized that any disciplinary proceedings against government employees must be conducted strictly in accordance with the applicable service rules and legal procedures.

The Supreme Court further underscored the importance of protecting the legal and financial rights of public employees, stating that administrative actions affecting employees’ salaries must remain within the limits prescribed by law.

Human Rights Perspective

The right to fair employment, lawful remuneration, and due process is a fundamental component of labor rights and the rule of law. Arbitrarily withholding or reducing an employee’s salary without legal authority can undermine economic security, human dignity, and procedural fairness. Judicial oversight of administrative actions plays a vital role in safeguarding workers’ rights, ensuring accountability, and promoting transparent governance.
