KARACHI (HRNW)- Following persistent non-compliance by Sindh Building Control Authority (SBCA) officials regarding court-ordered actions against illegal constructions, preparations are underway to file a formal contempt of court petition in the High Court of Sindh.
Case Background:
According to a legal notice issued by Advocate Nadeem Ahmed on behalf of his client, Mr. Sulman Fazal, the High Court of Sindh had previously directed the SBCA Appellate Committee (via Constitutional Petition No. D-585/2026) to adjudicate upon grievances regarding illegal construction within a strict 15-day timeline.
Key Allegations in the Notice:

Defiance of Directives: On March 11, 2026, the Appellate Committee issued clear orders to the Director (District East) and the concerned Deputy Director to conduct a site inspection under Grade-17 supervision and initiate enforcement action.

Deliberate Inaction: The notice highlights that despite the lapse of over 40 days, the field staff and officers of District East have failed to execute the inspection or take remedial measures.

Legal Breach: The communication categorizes this prolonged silence as “deliberate defiance” of the High Court’s mandate and a direct breach of the Sindh Civil Servants (Efficiency and Discipline) Rules.
Current Status:
The grace period provided in the legal notice to the Director General of SBCA has officially expired without any corrective action taken by the department. Consequently, the petitioner’s legal team is now finalizing a Contempt of Court application to be moved before the High Court.
Legal experts suggest that such “contemptuous conduct” by administrative officers—ignoring both internal committee orders and judicial mandates—could lead to serious disciplinary consequences or personal liability for the officers involved in District East.
