Islamabad (HRNW) — During the hearing of a contempt of court case concerning the transfer of PTI founder Imran Khan to a hospital, important constitutional questions regarding the jurisdictions of the Supreme Court and the Federal Constitutional Court came under discussion.
A three-member Supreme Court bench headed by Justice Shahid Waheed heard the case. The court sought legal assistance from Attorney General Mansoor Usman Awan regarding an order by the Federal Constitutional Court seeking the records of relevant cases and directing that they be fixed for hearing.
During the hearing, Justice Shahid Waheed asked whether the Federal Constitutional Court could call for cases from the Supreme Court and whether the Supreme Court would be bound by such an order.
Justice Shahid Waheed clarified that the court wanted to understand the intent and interpretation of the Constitution and that the questions should not be viewed negatively. He said the purpose of the questions was to better understand the matter.
Attorney General Mansoor Usman Awan submitted that the jurisdictions of the Federal Constitutional Court and the Supreme Court are clearly defined under the Constitution.
The jurisdiction concerning fundamental rights also came under discussion. Justice Shahid Waheed observed that issues relating to fundamental rights could arise in almost every case, while the right to a fair trial is of importance in every criminal proceeding.
Justice Shahid Waheed further stated that the judiciary believes in mutual respect among judicial institutions. The court accepted the Attorney General’s request for further legal assistance and adjourned the hearing for three weeks.
