Karachi (HRNW) – The Sindh High Court has granted bail to Madiha Islam, a co-accused in a case involving allegations of human trafficking and alteration of official documents related to the Saram Burney case.
The court approved the bail application and directed the accused to submit surety bonds of Rs100,000. During the hearing, the court expressed concern over delays in the trial proceedings and questioned the prosecution regarding the continuation of the case.
Justice Meeran Muhammad Shah expressed displeasure with the state counsel and remarked that the trial was not progressing while the main accused, Saram Burney, had already been released on bail.
The court questioned whether people could be kept in jail while the main accused remained outside and asked how convictions could be secured without proper progress in the trial.
The defence counsel informed the court that Madiha Islam had no direct connection with the allegations against Saram Burney and other accused persons. According to the defence, the allegation against Madiha Islam was that she handed over a child to Saram Burney, while she had no involvement in the alleged trafficking of children abroad.
The defence further argued that Madiha Islam had worked with Saram Burney in human rights and welfare activities and had been in custody for a long period. The lawyer requested bail on humanitarian and human rights grounds.
During the hearing, the state prosecutor argued that allegations against the accused included document forgery and the alleged trafficking of children abroad. The prosecutor stated that the case was registered following a complaint from the U.S. Embassy.
From a human rights perspective, such cases require fair trial guarantees, transparent investigations, protection of the legal rights of accused persons, and safeguarding of children from exploitation and trafficking. Under legal principles, every accused person has the right to due process and a fair hearing until a final judicial determination is made, while the protection of children remains a key responsibility of the state.
