KARACHI (HRNW): An Additional District and Sessions Court (South) has sentenced a man, identified as Osama Wadera, to 10 years of imprisonment after finding him guilty of raping a woman after promising to marry her. The court also imposed a fine of Rs. 50,000 on the convict.
Case Background and Allegations:
The prosecution’s case was based on the statement of the victim, who testified that the accused had established a relationship with her and gained her trust through a promise of marriage. According to the victim, on the night of November 27, 2024, the accused invited her to a guest house in DHA under the guise of introducing her to his family. Once there, he allegedly threatened her with a knife and subjected her to sexual assault. The FIR was subsequently registered at the Darakhshan Police Station.
Defense Arguments:
During the trial, the defense counsel argued that the allegations were fabricated. The lawyer claimed there were contradictions between the victim’s police statement and her testimony under Section 164, specifically regarding her movements outside the flat for refreshments. The defense further alleged that the dispute arose because the accused refused to marry the victim after she demanded a dowry (Haq Mehr) amounting to Rs. 5 million.
The Court’s Verdict:
The court, which delivered the sentence via video link, rejected the defense’s plea and maintained that the prosecution had successfully proved its case. Key points from the judgment include:
-
Credibility of Testimony: The court ruled that the victim’s statement was reliable and consistent.
-
Forensic Evidence: The verdict highlighted that DNA results, Medical Legal (ML) reports, and witness testimonies provided sufficient evidence of the crime.
-
Deception: The court remarked that the accused had exploited the victim’s trust by making a fraudulent promise of marriage and family introductions.
The convict has been ordered to pay the fine, the failure of which will result in additional prison time.
