Karachi (HRNW)- The Constitutional Bench of the Sindh High Court heard a petition regarding the non-provision of plots to approximately 650 affected allottees of the Gulshan Rufi / Pride Builder Scheme 33 in Karachi.
The petitioners alleged that despite clear court orders, builders have failed to transfer plot leases to the affected allottees.
During the hearing, the NAB prosecutor and investigating officer presented details before the court. The investigating officer informed the bench that a list of 60 affected allottees had been provided to the builders for processing.
He further stated that the conduct of the accused suggests they are unwilling to hand over plots to the rightful allottees, and despite repeated directions, the builders have not appointed a focal person to address the grievances of the affected parties.
The court was informed that the total number of complaints filed with NAB by affected individuals stands at 622.
Counsel for the builders, Barrister Salahuddin, disputed the NAB’s position, stating that many of the allottees included in the list had already been allotted plots.
On behalf of the affected parties, Advocate Malik Altaf Javaid argued that buyers had booked plots as far back as 1992, yet they have neither been provided possession nor lease documents to date. He further stated that despite repeated court orders, over 800 affected individuals are still awaiting relief.
He alleged that the builder has committed large-scale fraud through O.D.C charges amounting to millions of rupees, and that plots in Sector 21-B, 19-B, 6-C, and 6-B of Scheme 33 were sold without proper development work.
The counsel also claimed that over 100 allottees in Sector 21-B were issued leases for land reserved for public welfare facilities such as schools, colleges, and playgrounds, terming it a major irregularity.
The bench, headed by Justice Saleem Jesser, expressed strong displeasure over the lack of cooperation from the builders. The court observed that if the builders are not facilitating the affected allottees, the authorities should consider filing a reference against them.
The court was further informed that accused builders, including Rehmatullah, former Senator Qasim Lasi, and Manzoor Rufi, were involved in the matter.
The court has directed that implementation of its previous orders must be ensured and observed that compliance with the 2020 judgment regarding allotment and possession of plots is still pending.
The hearing was adjourned for further proceedings.
