KARACHI (HRNW): The Sindh High Court has issued a landmark judgment in a case concerning the recruitment of a Primary School Teacher (PST), dismissing a petition filed against the withholding of an appointment letter due to a dual domicile controversy. The court ruled that providing false information or concealing facts is sufficient ground for a candidate’s disqualification.
During the hearing, the petitioner’s counsel argued that despite passing the recruitment examination, his client was denied the appointment letter based on allegations of holding dual domiciles. The counsel contended that after relocating to Karachi, the petitioner had formally canceled his previous domicile from Rahim Yar Khan (Punjab), and therefore, his client was being subjected to discriminatory treatment.
On the other hand, the government counsel informed the court that the closing date for the job advertisement was April 2021, whereas the cancellation of the petitioner’s Punjab domicile did not take place until September 2024. Consequently, the petitioner failed to meet the mandatory eligibility criteria at the stipulated cutoff time.
After hearing the arguments from both sides, the Sindh High Court dismissed the petition and made the following observations:

One Citizen, One Domicile: The court clarified that a citizen is entitled to hold only one domicile and Permanent Residence Certificate (PRC). The acquisition or concurrent use of multiple domiciles is not permitted under any law.

Concealment of Facts: According to a letter issued by the Deputy Commissioner (DC) of Rahim Yar Khan, the petitioner’s previous domicile was canceled long after the job advertisement deadline. Prima facie, the petitioner concealed vital facts while applying for the position.

False Affidavit: Despite holding an active domicile from another province, the petitioner failed to disclose this fact, which subsequently proved that the affidavit submitted by him regarding the accuracy of his information was false.
The court maintained that failing to provide complete and accurate information and hiding crucial details constitutes sufficient grounds for disqualification, subsequently dismissing the petitioner’s plea.
