Anti-Corruption Court Dismisses Plea Against Detention of Former Yellow Line Project Director Zamir Abbasi

KARACHI (HRNW): The Provincial Anti-Corruption Court has rejected and dismissed a petition filed against the alleged illegal detention of Zamir Abbasi, the former Project Director of the Yellow Line bus project. The court issued this order following the unexpected departure of the petitioner’s counsel and the failure to meet essential legal prerequisites.

According to details, the petition against the alleged illegal custody was filed by Advocate Kashif Khan. The defense counsel had contended that anti-corruption authorities were holding Zamir Abbasi in illegal confinement, and despite the lapse of more than 24 hours, he had not been produced before the relevant court. The counsel had prayed the court to direct anti-corruption authorities to present the FIR and the arrest memo, declare the detention unlawful, and order the immediate release of Zamir Abbasi.

However, during the proceedings, the situation took a turn when the petitioner’s counsel abruptly left the courtroom without assigning any reason. In its written order, the court made the following crucial observations:

  • Counsel’s Sudden Departure: When the petition was taken up for hearing, the petitioner’s counsel left the court without providing any justification or notifying the bench.

  • Absence of Legal Documents: The counsel neither properly submitted his Power of Attorney (Wakalatnama) nor produced any supporting documents or evidence related to the case before the court.

  • Grounds for Denying Relief: The court clarified that it is the fundamental responsibility of the petitioner’s counsel to satisfy the court regarding the maintainability of the petition. Under such circumstances where legal requirements are completely unmet, the court cannot grant any relief on the plea.

Consequent to the absence of the legal counsel and the non-provision of necessary documentation, the court dismissed the application seeking the release of the former Project Director and the declaration of his detention as illegal.
