Did you know…?
In Pakistan, the police cannot arrest you at any time or for any reason. Do you know when a warrantless arrest is considered illegal? And if the police act unlawfully, what rights do you have?
Our guide today is divided into five essential parts — read till the end because this information could literally save you from wrongful imprisonment.
Part 1: When Can the Police Arrest You?
According to Pakistani law, the police can only make an arrest without a warrant under three circumstances:
✅ If someone is caught committing a crime
✅ If the person is wanted in a serious offense
✅ If there is a court order
❌ However, if:
- A person is arrested only on suspicion
- Standing on the street
- Asking questions or challenging an officer
Then such an arrest is illegal.
Part 2: What Police Cannot Do
It’s essential to know what the police cannot legally do:
❌ Check your mobile or personal devices without reason
❌ Enter your home at night without cause
❌ Arrest women with male officers only
❌ Demand bribes
❌ Detain you without filing an FIR
If any of these happen, it is considered a violation of the law.
Part 3: Laws Regarding Arrest of Women
Special protections exist for women under Pakistani law:
✔ Women cannot be arrested after 6 PM
✔ Female police must be present during the arrest
✔ Warrantless arrests are illegal
✔ Women must be transported in a separate vehicle
Breaking these rules makes the arresting officer legally liable.
Part 4: What to Do If Police Misbehave or Overstep
Don’t panic — the law is on your side:
✔ Immediately call 15 (emergency helpline)
✔ Note the officer’s name and badge number
✔ Record video evidence if possible
✔ File a complaint with SSP or DIG
✔ Register the complaint through the Citizen Portal
Remember:
Silence gives power to abuse.
Part 5: Your Fundamental Legal Rights
📌 Every citizen has the following legal rights under the Constitution of Pakistan:
✔ To know the reason for arrest
✔ To consult with a lawyer
✔ To be presented in court within 24 hours
✔ Protection against any form of torture or abuse
Closing Message
Law isn’t just written in books —
It becomes truly powerful when citizens know and exercise it.
If we remain silent, abuses continue to rise.
But when we are aware, injustice naturally diminishes.
