Lahore – Pakistan (HRNW)- The Lahore High Court, Multan Bench, in W.P No. 13661/2025, issued a landmark decision protecting the fundamental rights of air passengers across Pakistan.
According to the ruling, if a passenger is offloaded at any airport in Pakistan, the relevant authority is now legally required to provide a written explanation for the action. A verbal explanation or a vague reference to “system issues” will no longer suffice.
The judgment affirms passengers’ rights under the Constitution of Pakistan, including:
- Article 4 – Right to lawful treatment
- Article 9 – Right to personal liberty
- Article 10-A – Right to fair trial and transparent procedure
The court emphasized that offloading is not a discretionary administrative decision, but a process subject to law and constitutional safeguards. Every offloading must be accompanied by a formal written justification.
Passengers who are offloaded without a written reason now have the full right to file a constitutional petition in the Lahore High Court against the responsible authority.
This ruling marks a significant step in safeguarding passengers’ legal and constitutional rights in Pakistan’s aviation sector.
