Supreme Court Restores Promotion Rights of Government Employees, Overturns Punjab Service Tribunal Decision

Islamabad (HRNW)- The Supreme Court has delivered a landmark verdict in a case related to the promotion of government employees, restoring the right of eligible officers to be promoted from the date of the first Departmental Promotion Committee (DPC) meeting.

In its ruling on the delayed promotion case, the Supreme Court declared the decision of the Punjab Service Tribunal null and void and ordered that the promotion of government employee Fakhar Majeed be considered effective from January 21, 2012.

According to the verdict, the Punjab Service Tribunal had earlier rejected Fakhar Majeed’s appeal and held that an employee is not entitled to promotion from the date a post becomes vacant. The Supreme Court rejected this interpretation and ruled that an eligible government employee has the right to promotion from the date of the first DPC meeting.

The seven-page written judgment was authored by Justice Ayesha Malik, while the bench also included Justice Muhammad Hashim Kakar and Justice Ishtiaq Ibrahim. The court stated that promotion is a fundamental right of government employees and that administrative negligence or delays should not deprive employees of their lawful entitlements.

The apex court further directed government institutions to ensure a timely promotion process, emphasizing that employees cannot be punished for administrative failures or procedural delays.
