Petition Regarding Karachi Bar Association Elections Dismissed

Karachi (HRNW)- The Sindh High Court has dismissed a petition seeking the postponement of the Karachi Bar Association (KBA) elections.

During the hearing, petitioner Advocate Mumtaz Tanoli argued that the Karachi Bar Association had failed to take any lawful steps to conduct the elections. He further contended that the participation of two members of the Sindh Bar Council in the KBA elections constituted a conflict of interest.

The petitioner also maintained that despite the expiry of the Karachi Bar Association’s term, the Sindh Bar Council did not assume interim administrative control of the Bar’s affairs.

In its remarks, the court observed that the Karachi Bar Association and the Sindh Bar Council are autonomous institutions. The court emphasized that where appropriate forums exist for the resolution of disputes, the constitutional writ jurisdiction should not be invoked.

The bench further held that the petitioner had failed to establish any violation of the fundamental rights of an individual. The court noted that disputes relating to the exercise of authority after the expiry of term or allegations of non-transparent elections fall within the jurisdiction of the relevant forums.

Accordingly, the court ruled that the petitioner may approach the competent forum for redress, and dismissed the petition.
