The verdict was delivered by <b data-path-to-node=\"2\" data-index-in-node=\"291\">Justice Adnan Iqbal Chaudhry<\/b> in response to Constitutional Petition No. <b data-path-to-node=\"2\" data-index-in-node=\"363\">D-1592\/2025<\/b>.<\/h3>\n<p data-path-to-node=\"3\">The petition was filed by the managing committee of <b data-path-to-node=\"3\" data-index-in-node=\"52\">Sajjad Model Higher Secondary School, Khairpur<\/b>, concerning the implementation of <b data-path-to-node=\"3\" data-index-in-node=\"133\">Section 10 of the Sindh Right of Children to Free and Compulsory Education Act 2013<\/b>. Representing the school, <b data-path-to-node=\"3\" data-index-in-node=\"243\">Barrister Fahad Farooq<\/b> and <b data-path-to-node=\"3\" data-index-in-node=\"270\">Advocate Jahangir Kalhoro<\/b> from the prominent firm <b data-path-to-node=\"3\" data-index-in-node=\"320\">F&amp;J Legal Advisors<\/b> successfully argued that while the state must ensure free education for the poor, the process should not become a tool for administrative harassment.<\/p>\n<h3 data-path-to-node=\"4\"><b data-path-to-node=\"4\" data-index-in-node=\"0\">Key Highlights of the Verdict<\/b><\/h3>\n<ul data-path-to-node=\"5\">\n<li>\n<p data-path-to-node=\"5,0,0\"><b data-path-to-node=\"5,0,0\" data-index-in-node=\"0\">Constitutional Mandate:<\/b> The court reaffirmed that providing free education to children from poor and middle-class backgrounds is both a constitutional and legal responsibility.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"5,1,0\"><b data-path-to-node=\"5,1,0\" data-index-in-node=\"0\">Limiting Anti-Corruption Authority:<\/b> The court ruled that the <b data-path-to-node=\"5,1,0\" data-index-in-node=\"61\">Anti-Corruption Establishment (ACE)<\/b> only has the authority to verify reports and lacks the jurisdiction to conduct criminal investigations against private schools under the guise of educational oversight.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"5,2,0\"><b data-path-to-node=\"5,2,0\" data-index-in-node=\"0\">Transfer of Jurisdiction:<\/b> Justice Chaudhry ordered that all ACE verification proceedings be terminated. All relevant records are to be transferred to the <b data-path-to-node=\"5,2,0\" data-index-in-node=\"154\">Directorate of Inspection and Registration of Private Institutions<\/b>, which remains the sole competent authority for monitoring school compliance.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"5,3,0\"><b data-path-to-node=\"5,3,0\" data-index-in-node=\"0\">Security Measures:<\/b> Addressing concerns raised by F&amp;J Legal Advisors regarding the safety of staff and students, the court reviewed police reports and expressed satisfaction with the deployment of personnel outside school premises.<\/p>\n<\/li>\n<\/ul>\n<h3 data-path-to-node=\"6\"><b data-path-to-node=\"6\" data-index-in-node=\"0\">Legal Significance<\/b><\/h3>\n<p data-path-to-node=\"7\">Legal experts have hailed this as a &#8220;balanced decision&#8221; of 2026.
