Karachi (HRNW)<\/strong> \u2013 The Constitutional Bench of the Sindh High Court<\/strong> has dismissed a petition filed by a contract employee of the Zulfiqarabad Development Authority (ZDA)<\/strong> seeking permanent employment, declaring the petition inadmissible at the preliminary stage.<\/p>\n

The court observed that a contract employee does not acquire a legal right to permanent employment merely on the basis of serving for a long period.<\/strong><\/p>\n

During the hearing, the petitioner Sajjad Ali\u2019s<\/strong> counsel argued that his client had served as Deputy Director on a contract basis from 2015 to 2024<\/strong> and had never faced any allegation of corruption or departmental disciplinary action.<\/p>\n

The petitioner\u2019s lawyer further stated that the Chief Minister of Sindh, in his capacity as Chairman of the Governing Body, had directed the regularization of employees<\/strong>, but the relevant authorities allegedly did not implement the Sindh Cabinet\u2019s instructions. The counsel also argued that other contract employees had been regularized in 2017 and 2021<\/strong>.<\/p>\n

The court noted that the petitioner\u2019s contract had expired in 2024<\/strong> and that contract employment remains subject to the terms and conditions of the agreement.<\/p>\n

Justice Adnan-ul-Karim Memon<\/strong> remarked that a contractual agreement does not create any legal right to permanent appointment. He stated that permanent appointment requires a legal provision or an approved policy by the competent authority.<\/p>\n

The court further observed that the Sindh Regularization of Adhoc and Contract Employees Act<\/strong> applies only to employees appointed within the dates specified under the law, and the petitioner does not fall within that legal framework.<\/p>\n

The petition was therefore dismissed.<\/p>\n
