Islamabad (HRNW)-\u00a0The move to impose a 50 percent additional toll and fine on non-M-Tag vehicles and M-Tag vehicles with insufficient balance has been challenged in the Islamabad High Court.<\/p>\n
Lawyer Muhammad Jalal Haider has filed a petition against the National Highway Authority (NHA), making the Ministry of Communications, the NHA, and other relevant authorities respondents in the case.<\/p>\n
According to the petition, the NHA, through a notification issued on May 30, 2025, imposed a 50 percent additional toll as a penalty on non-M-Tag vehicles and M-Tag users with low balances, which the petitioner argues is contrary to the law.<\/p>\n
The petitioner contends that under Section 10 of the NHA Act, only toll tax can be collected. The law does not authorize fines on non-M-Tag vehicles or additional charges on M-Tag users with insufficient balances.<\/p>\n
The petition further states that the NHA\u2019s action violates Articles 4, 18, 24, and 25 of the Constitution and requests the court to declare the May 30, 2025 notification unconstitutional and set it aside.<\/p>\n
The petitioner has also asked the court to order the refund of additional fines collected under the notification and to seek complete details from the NHA regarding M-Tag balances and the procedures governing their use.<\/p>\n
The petition was filed in the Islamabad High Court by Yahya Farid Khawaja on behalf of Advocate Muhammad Jalal Haider.<\/p>\n
