Scope and Inclusivity<\/b><\/h3>\n<p id=\"p-rc_bcc19972cae7e50b-44\" data-path-to-node=\"2\"><span class=\"citation-75\">Initially focused on women in formal employment, the <\/span><b data-path-to-node=\"2\" data-index-in-node=\"53\"><span class=\"citation-75\">2022 Amendment<\/span><\/b><span class=\"citation-75 citation-end-75\"> radically expanded the law:<\/span><\/p>\n<ul data-path-to-node=\"3\">\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-45\" data-path-to-node=\"3,0,0\"><b data-path-to-node=\"3,0,0\" data-index-in-node=\"0\">Broadened &#8220;Complainant&#8221;:<\/b><span class=\"citation-74\"> The law now protects <\/span><b data-path-to-node=\"3,0,0\" data-index-in-node=\"46\"><span class=\"citation-74\">&#8220;any person&#8221;<\/span><\/b><span class=\"citation-74 citation-end-74\"> regardless of gender, including the transgender community and men.\u00a0<\/span><\/p>\n<\/li>\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-46\" data-path-to-node=\"3,1,0\"><b data-path-to-node=\"3,1,0\" data-index-in-node=\"0\"><span class=\"citation-73 citation-end-73\">Expanded &#8220;Workplace&#8221;:<\/span><\/b><span class=\"citation-72 citation-end-72\"> It covers both formal and informal sectors, including domestic workers, home-based workers, gig workers, performers, students, and even athletes in sports facilities.<\/span><\/p>\n<\/li>\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-47\" data-path-to-node=\"3,2,0\"><b data-path-to-node=\"3,2,0\" data-index-in-node=\"0\"><span class=\"citation-71\">Extended Reach:<\/span><\/b><span class=\"citation-71 citation-end-71\"> A &#8220;workplace&#8221; now includes any place where work is performed, such as streets (for field workers), courts, or digital spaces (addressing cyber-harassment).<\/span><\/p>\n<\/li>\n<\/ul>\n<h3 data-path-to-node=\"4\"><b data-path-to-node=\"4\" data-index-in-node=\"0\">2. Defining Harassment<\/b><\/h3>\n<p id=\"p-rc_bcc19972cae7e50b-48\" data-path-to-node=\"5\"><span class=\"citation-70 citation-end-70\">The law identifies three main manifestations of harassment:\u00a0<\/span><\/p>\n<ol start=\"1\" data-path-to-node=\"6\">\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-49\" data-path-to-node=\"6,0,0\"><b data-path-to-node=\"6,0,0\" data-index-in-node=\"0\">Abuse of Authority (Quid Pro Quo):<\/b><span class=\"citation-69 citation-end-69\"> Demanding sexual favors in exchange for job benefits (promotion, salary increase).<\/span><\/p>\n<\/li>\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-50\" data-path-to-node=\"6,1,0\"><b data-path-to-node=\"6,1,0\" data-index-in-node=\"0\">Hostile Environment:<\/b><span class=\"citation-68 citation-end-68\"> Unwelcome conduct that creates an intimidating, abusive, or offensive work atmosphere.<\/span><\/p>\n<\/li>\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-51\" data-path-to-node=\"6,2,0\"><b data-path-to-node=\"6,2,0\" data-index-in-node=\"0\"><span class=\"citation-67\">Gender-Based Discrimination:<\/span><\/b><span class=\"citation-67 citation-end-67\"> The 2022 amendment clarifies that harassment includes discrimination based on gender that may not be sexual in nature but reflects a prejudicial mindset.<\/span><\/p>\n<\/li>\n<\/ol>\n<h3 data-path-to-node=\"7\"><b data-path-to-node=\"7\" data-index-in-node=\"0\">3. The Complaint Mechanism<\/b><\/h3>\n<p id=\"p-rc_bcc19972cae7e50b-52\" data-path-to-node=\"8\"><span class=\"citation-66\">Every organization is legally required to display a <\/span><b data-path-to-node=\"8\" data-index-in-node=\"52\"><span class=\"citation-66\">Code of Conduct<\/span><\/b><span class=\"citation-66\"> and establish a permanent <\/span><b data-path-to-node=\"8\" data-index-in-node=\"94\"><span class=\"citation-66\">Inquiry Committee<\/span><\/b><span class=\"citation-66 citation-end-66\">.<\/span><\/p>\n<ul data-path-to-node=\"9\">\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-53\" data-path-to-node=\"9,0,0\"><b data-path-to-node=\"9,0,0\" data-index-in-node=\"0\">Internal Inquiry Committee:<\/b><span class=\"citation-65 citation-end-65\"> Must consist of three members (at least one woman).<\/span> Upon receiving a written complaint, they must initiate proceedings within <b data-path-to-node=\"9,0,0\" data-index-in-node=\"154\">3 days<\/b> and provide findings to the &#8220;Competent Authority.&#8221;<\/p>\n<\/li>\n<li>\n<p id=\"p-rc_bcc19972cae7e50b-54\" data-path-to-node=\"9,1,0\"><b data-path-to-node=\"9,1,0\" data-index-in-node=\"0\"><span class=\"citation-64\">The Ombudsman:<\/span><\/b><span class=\"citation-64\"> If an employee does not wish to use the internal committee or if the organization hasn&#8217;t formed one, they can complain directly to the <\/span><b data-path-to-node=\"9,1,0\" data-index-in-node=\"150\"><span class=\"citation-64\">Federal or Provincial Ombudsman (Mohtasib)<\/span><\/b><span class=\"citation-64 citation-end-64\">.<\/span><\/p>\n<p id=\"p-rc_bcc19972cae7e50b-55\" data-path-to-node=\"9,2,0\"><b data-path-to-node=\"9,2,0\" data-index-in-node=\"0\"><span class=\"citation-63\">Timelines:<\/span><\/b><span class=\"citation-63\"> The Ombudsman is now bound to decide cases or appeals within <\/span><b data-path-to-node=\"9,2,0\" data-index-in-node=\"72\"><span class=\"citation-63\">90 days<\/span><\/b><span class=\"citation-63 citation-end-63\"> to ensure swift justice.<\/span><\/p>\n<p>&nbsp;<\/li>\n<\/ul>\n<h3 data-path-to-node=\"11\"><b data-path-to-node=\"11\" data-index-in-node=\"0\">4.
