KARACHI (HRNW)-\u00a0<\/b>A two-member constitutional bench of the Sindh High Court, led by Justice Yousuf Sayeed and Justice Muhammad Osman Ali Hadi, has recused itself from hearing a long-standing case regarding the implementation of the Right to Information (RTI) law. During the proceedings, the bench directed that the case should not be presented before either of its members in the future and ordered the matter to be referred to the Chief Justice of the Sindh High Court for the constitution of a new bench.<\/p>\n

The petitioner, Dr. Murtaza Khuhro, informed the court that it has been four years since the application for the implementation of the court’s orders was filed. He emphasized that under Section 6 of the RTI Act, it is mandatory for all government departments to proactively make information public. Dr. Khuhro argued that the primary objective of the law is to ensure transparency in government affairs, which would significantly reduce corruption and foster a sense of civic participation among the general public.<\/p>\n

The petitioner further lamented that various departments are consistently failing to comply with the law, despite its clear provisions for transparency. He urged the court to issue a definitive order for implementation to ensure that the public\u2019s right to know is protected. With the recusal of the current bench, the legal community and transparency advocates now await the formation of a new bench to decide on this critical matter of administrative accountability.<\/p>\n
