Declaring the petitions &#8220;not maintainable,&#8221; the court ruled that complex disputes involving land ownership and lease validity fall outside its constitutional jurisdiction and should be pursued in a civil court.<\/p>\n<h3 data-path-to-node=\"2\"><b data-path-to-node=\"2\" data-index-in-node=\"0\">Arguments and Legal Contention<\/b><\/h3>\n<p data-path-to-node=\"3\">During the proceedings, both parties presented conflicting accounts regarding the land&#8217;s status and its designated use:<\/p>\n<ul data-path-to-node=\"4\">\n<li>\n<p data-path-to-node=\"4,0,0\"><b data-path-to-node=\"4,0,0\" data-index-in-node=\"0\">Petitioner\u2019s Stand:<\/b> The counsel for the petitioners argued that the Karachi Development Authority (KDA) had originally earmarked this land for a petrol pump under the Master Plan. They contended that granting permission for a high-rise building on this specific plot was illegal and a violation of urban planning regulations.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"4,1,0\"><b data-path-to-node=\"4,1,0\" data-index-in-node=\"0\">Government\u2019s Response:<\/b> The government\u2019s counsel countered that the allotment of this land was finalized in 1963, predating the formal KDA scheme for the area. Furthermore, they argued that the petitioners lacked the legal standing (<i data-path-to-node=\"4,1,0\" data-index-in-node=\"232\">locus standi<\/i>) to intervene, as they were not directly affected parties.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"4,2,0\"><b data-path-to-node=\"4,2,0\" data-index-in-node=\"0\">SBCA\u2019s Position:<\/b> The court noted that, on the surface, the construction plan approved by the Sindh Building Control Authority (SBCA) appeared to comply with all existing legal requirements and building codes.<\/p>\n<\/li>\n<\/ul>\n<h3 data-path-to-node=\"5\"><b data-path-to-node=\"5\" data-index-in-node=\"0\">The Court\u2019s Verdict and Observations<\/b><\/h3>\n<p data-path-to-node=\"6\">The bench dismissed the petitions while outlining several key legal principles:<\/p>\n<ol start=\"1\" data-path-to-node=\"7\">\n<li>\n<p data-path-to-node=\"7,0,0\"><b data-path-to-node=\"7,0,0\" data-index-in-node=\"0\">Jurisdictional Limits:<\/b> The court observed that the core of the dispute involves the determination of land ownership, lease validity, and the jurisdiction of various institutions. These are matters of a &#8220;civil nature&#8221; that require a detailed examination of evidence, which a constitutional court cannot perform.<\/p>\n<\/li>\n<li>\n<p data-path-to-node=\"7,1,0\"><b data-path-to-node=\"7,1,0\" data-index-in-node=\"0\">Civil Court as the Proper Forum:<\/b> The SHC emphasized that a constitutional court is not an alternative forum for a civil court.
